Amendment 46 foes end lawsuit

Opponents of Amendment 46, which would prohibit the state from using race or gender preferences and would eliminate most affirmative action programs, agreed to drop their legal challenge to the measure on Wednesday.

Melissa Hart, of Coloradans for Equal Opportunity said the lawsuit, based on challenges to signatures that put the measure on the November ballot, was handicapped by a ruling that the group couldn't include challenges to entire petitions based on questions about the legality of the signature gatherers themselves.

"We decided it made sense to drop it," Hart said.

"We continue to believe the judge's order was legally erroneous but at some point you have to surrender those battles," she added.

Jessica Corry, of the Colorado Civil Rights Initiative, which is sponsoring the measure, welcomed the move, which both sides agreed to in a stipulated settlement before Denver District Judge William Robbins.

"This outcome was inevitable given the fact that the courts threw out most of their claims,and they failed to provide a single shred of evidence for any remaining claims," she said.
