Lawmakers want close look at laws and enforcement

Three Aurora legislators on Thursday called for a comprehensive audit of the state's immigration laws and how police and federal immigration authorities are enforcing them.

Their request comes a week after an illegal immigrant allegedly broadsided a pickup truck in Aurora, killing two women and a 3-year-old boy in an ice cream shop.

The suspect, Francis Hernandez, 23, had been arrested nearly 20 times in the past five years but had never been deported, despite a 2006 state law that requires police to report foreign-born suspects to Immigration and Customs Enforcement.

Hernandez was charged Thursday with three counts of leaving the scene of an accident involving death, three counts of vehicular homicide, one count of vehicular assault, one count of leaving the scene of an accident involving serious bodily injury and one count of driving under restraint. If convicted, he could face up to 78 years in prison. His bail was increased to $350,000.

State Reps. Morgan Carroll and Karen Middleton and state Sen. Suzanne Williams are seeking an audit of all of Hernandez's contacts with police.

They also want an analysis of "every crack or gap" in legislation and the enforcement of existing laws.

"And while the federal government has primary jurisdiction over immigration law, we have primary responsibility for the existence and enforcement of our traffic laws," the legislators wrote in a joint letter to the legislative audit committee. "Had the current laws and enforcement worked properly, these citizens would not be dead."

Debra Serecky, 51, of Aurora, and Patricia Guntharp, 49, of Centennial, were killed Sept. 4 when their pickup truck was broadsided. Marten Kudlis, 3, of Aurora, was inside the Baskin-Robbins ice cream shop with his mother when he was snared by the careening wreckage and dragged to his death.

The deaths became a lightning rod for increased immigration reform when it was determined that Hernandez was born in Guatemala and in the United States illegally.

However, his lawyer, Kallman Elinoff, said Thursday that Hernandez's father is a legal resident and his sister has become a U.S. citizen but Hernandez did not complete the process to gain legal status.

He did obtain a Social Security card as a child, Elinoff said.

After graduating from high school in California, Hernandez tried to enlist in the Army but was turned away because of his immigration status, Elinoff said.

Hernandez quickly began racking up arrests, mainly for misdemeanor traffic offenses, but largely avoided scrutiny of his legal status.

Aurora police say Hernandez was referred to ICE after he was arrested in April for speeding and driving without a license. ICE officials say they have no record of Hernandez ever being referred to them before last week's crash.

Arapahoe County District Attorney Carol Chambers said prosecutors are looking at the possibility of filing additional, "even more serious" charges. She would not elaborate.

"We have three people who are dead and one of them is a 3-year-old child," Chambers said. "It's a heartbreaking case and so unnecessary."

After the hearing, Guntharp's son, Richard Gagne, 32, said he went to court hoping for a little bit of closure before he heads to Iraq. Gagne is in the Army.

"It's a piece of me that is now gone. It hurts," Gagne said of losing his mother.

"Hopefully, someday that emptiness will be filled."

When parents dont have time to raise a son or daughter or have children to stay in the country the usual product is a criminal! Dont think so? check LA and the offspring of those illegals. I know I lived there.....

    I admit to not knowing the procedures in getting a green card, so bear with me. If he has been here since he was 5, why couldn't he get his green card and at least be documented? Is it a matter of not having the funds to apply? I don't understand why people would choose to be here illegaly? Is it that hard to get a green card?

    I don't care what his bond is, I would hope that the bail bonds community refuse to bond him out. If they do, he will once again be in the wind.

However, we all went through the lengthy process of bringing them here legally. I had to reschedule my wedding 4 times because of difficulty in getting a timely visa. The wheels of the government turn slow. However, I was like Denverbusinessman meaning that I have turned the other way so to speak knowing that most of people I used to teach in my ESL class were here illegally. My tolerance for this has ended. My family and I have spent thousands of dollars to do things right and it makes me upset to see so many freeloaders come in here illegally and mooch off of everything I work for.

    If Hernandez were to somehow post bond, he would be sent directly to ICE for jail so why bother. Either way our tax payer dollars are paying for his selfish a## to hang out here in our legal system which apparently has failed us all up to this point.

    Hickenlooper has never been in a position to affect plea bargains and those on here who attack him on this case just demonstrate that their minuscule one track minds are incapable of even trying to get beyond their prejudices and reactionary political hatred.

    Finally nonnative, he gets bond because it is a right guaranteed to all people by the State and Federal constitution. I understand that you feel that civil rights do not apply to people you do not like, but fortunately the constitution still applies. It helps keep loudmouths like you from forming lynch mobs (although I doubt you have it in you to act rather than just spout off.) This guy, like everyone else, is still innocent until proven guilty. Again, I know that you think that anyone with brown skin needs to just go away, but more rational minds still prevail.

    People are free to be outraged by these deaths, but to get on here and spew the hatred shown in the last few days says more about the lack of morality of the posters than it does about the crime or the accused.

    I agree that he should be denied bond given his past record of failing to appear. It seems ICE will hold him if he gets out provided the two agencies bother to communicate with each other. For some reason, ICE hasn't held him in the past like it should have.

    It seems to me that if immigrants elect to come here illegally, they should be very careful to follow our laws. Most do, I'm sure.

    One concern is that law enforcement doesn't bother to inform anyone of our laws. Kids entering adulthood should get a short course on the law and there should be a Spanish version of our laws that can be passed around among immigrants.

This evil man took away this familys little boy who they loved so dearly, he should live the rest of his life behind bars. I attended the funeral and I want to thank the parents for allowing me to go. I have a little boy the same age and I could not imagine living my life without him, no parent should ever have to go through something like this. I want to let his parents know that my heart aches with theirs and I too had fallen asleep last night and woke today with tears and sorrow. This boy was so beautiful and so innocent and should still be here today in the arms of his mother and father. I will always remeber Marten Kudlis and will think of him everyday.

I brought her here from the philippines { the hardest country } it took about 9 months just to get her here and another 6 months { lost paperwork not me } and now she is here legaly .It takes time with the background checks and the paperwork but there is alot of reasons they do it!! I also worked on a roofing crew and when they worked they did a great job but they also bragged how they got more money for doing NOTHING over here. We would leave to go get shingles and come back and they were sitting on their butt eating burritos and NOT working it took us a week to do a job that would take a good working crew three days. It is ridiculous. Lets not take it to the food stamp office!!! I have a disabled son and I had to fight to get food stamps they have 5-7 kids per family and we pay for EVERYTHING and my son and I are stuck eating out of church pantries!! What about his formor convections?? I don't get it. This government is slipping!

    It also says a lot about the attitude in Denver. The victim's families deserve respect. They do not deserve everyone's personal agenda tacked on to their loss.

    It's always interesting to see the things that people say on the internet; those who hide behind the anonymity of a message board...the internet brave and the digital brazen.

    Everyone is entitled to their own opinion. Whining about it anonymously will never achieve anything. If you really want to change something, organize, demonstrate, vote. Stop being an anonymous coward and step forth and be heard.

    I, also, have to agree with brokenforum in that we the people need to get off our collective a$$es & actively seek those that would be elected and make it clear that no head-first, immediate, confrontation with the present immigration issues = not elected. We, also, need to unseat most, if not all, incumbents as they have, almost to a man (woman) have been totally faithless to the American public in regard to this and a multitude of other issues.

    And I have personally lobbyed those that are in, and have been in office, presenting my views that they would accept me as a constituent and act on my suggestions. Well, it's supposed to work that way but doesn't seem to make much difference. It makes me feel better ( if not terribly jaded at this point ) & gives me the right to bit(h, personally or anonymously.

    I am offended by the notion that there is a parallel between the massacre of my people by the state, and Americans' recent zest to control the forces of illegal immigration.
    Like Businessman, I am an old native and did not previously feel any animus toward "Mexicans" but have become aware of an irritation about these ongoing illegal immigration issues. It is the persons' behavior -- not their blood, genetic flaws or mere existence, not their education or advancement, not their land holdings or cultural impact -- that we are discussing.
    It could be said that the failure to create rules to control this behavior and disallow American business from using these people to drive down their labor costs, itself inspires racial hatred.
    When people are not held to the same RULES as the rest of us, that is the problem and the one on the table at this point. You may be 100% sure that when and if the American populace starts to burn the books of any particular segment of society -- or starts to go door to door with the intent of "railroading" them to their deaths -- you will not hear me agreeing with such fundamental Evil. Mine will be the home of refuge and the death of prideful commitment if necessary.
    But that is NOT what we are discussing, and the above-stated parallel is disturbing to me.
    What we ARE discussing is whether undocumented people are being predated by working under the table, receiving public educational and health benefits for which the rest of us are paying Big Time, and what is the right way to address the fact that we have to punish them if they break our traffic laws and kill innocent people eating ice cream (ARE we required to give them, in prison, a higher shot at survival than many poverty-stricken families?).
    That's a legitimate issue to discuss without making those of us who HAVE come to feel irritated by it, also feel guilty that we are engaging in some sort of sadistic wholesale genocide in our inner thoughts. We're NOT.

    I have been involved in this issue for awhile and have seen a lot of people get fired up over immigration and then that fire dies out and they go back to wishing someone would do something about it.

    That is a great video on the front page.
    I think that was the site that had some good videos from an immigration protest out in CA a few years ago. People were protesting some artwork in a public park glorifying illegal entry in to the US. It got pretty nasty and I think a lot of people are not prepared for that.
    I am a big fan of the Numbers site and their email and fax alerts.

    I must assume that you believe anyone who favors controlling illegal immigration must be a Nazi. I love your typical left wing tactics, you can't make a rational argument against illegal immigration, so you will lump all immigration (legal and illegal) together and then you start name calling.
