Suspect remained free despite 16 prior brushes with law

Aurora authorities alerted U.S. immigration officials in April that Francis Hernandez might be an illegal immigrant, Aurora police spokesman Bob Friel said Monday.

But the feds didn't detain Hernandez. He remained free, despite 16 prior brushes with the law. And on Thursday, Hernandez, 23, allegedly broadsided a truck in Aurora, killing three people, including a toddler.

The tragedy has many in the community demanding answers.

Why wasn't Hernandez - who immigration officials said Monday they believe is a Guatemalan national here illegally - deported long ago?

Why, after 16 arrests, wasn't he behind bars?

"It shouldn't take a car accident and three people passing away for the government and the police to realize he should have been gone a long time ago," said Ricky Staats, whose mother, Debra Serecky, 51, was one of the victims.

The incident has also reignited a debate about U.S. immigration policies. Gov. Bill Ritter said in a statement Monday he was outraged that an illegal immigrant with a lengthy rap sheet had remained free "to kill three innocent people."

"This is exactly why Washington needs to finally show leadership and enforce existing immigration laws and craft a comprehensive strategy for the future," Ritter said.

Immigration and Customs Enforcement officials said they have no record of Aurora contacting them April 25, when Hernandez was arrested in Aurora for speeding and driving without a valid license.

"He's never been referred to ICE before (the Thursday triple fatality)," said ICE spokesman Carl Rusnok. "He has routinely been giving various aliases and places of birth," Rusnok added. Given that he provided bogus information, "it's understandable why (local law enforcement agencies) may not have suspected that he was an illegal alien and therefore did not refer him to us."

But Friel disputes that. In fact, Aurora police made more than 2,500 referrals to ICE last year, but ICE responded only "a fraction of the time," Friel said.

"The police are doing their job by arresting and locking him up 16 times," Friel said. "It's up to ICE to deport illegal immigrants out of the country, not local law enforcement," he said. "We're at a boiling point."

Police say Hernandez sped through a red light and broadsided a pickup truck, killing Serecky, of Aurora, and Patricia Guntharp, 49, of Centennial. Also killed was Marten Kudlis, 3, of Aurora.

In court Monday, Hernandez hung his head as District Court Judge Anne Ollada raised his bail to $250,000. He will return to court Thursday to face formal charges.

Clad in an orange jail jumpsuit and handcuffs, Hernandez briefly made eye contact with several family members in court, including his girlfriend, who carried his baby in her arms. Hernandez's attorney, Kallman Elinoff, said Hernandez is "just devastated."

But Vito Kudlis, who lost his only son, Marten, didn't buy it. "This guy did bad things and something needs to change." Kudlis will bury his little boy Wednesday.

    Wait a second. Bill Ritter of plea bargain to agricultural trespass fame is "outraged?" Wow. That's better than a cup-of-coffee in the morning to get my blood flowing. Ritter can point a finger at Washington all he wants in this case, but here's the difference: at least the City of Aurora notified the feds and let them blow it off. Ritter and his DA's office / City of Denver didn't even notify the feds on his "agricultural trespass" plea-bargains. That's because the whole purpose behind the plea deal was an allowance for the criminals to stay in the country. Nice try, Ritter. I don't buy your phony "outrage" line - you're part of the problem. Always have been, always will be.

    Sorry folks, but answers have been available for years. There are more Americans killed annually through one means or another, from rape to vehicular homicide, and these are deaths that by not having turned a blind eye to illegal immigration would not have happened. The statistics are there to prove it. Having been in the fight against illegal immigration for the past 7 years I can tell you that you haven't seen anything yet. Your politics, demographics and form of government "are going to, or are changing at an extreamly rapid rate and you will not like it! Keep ignoring it and you will pay the price. This is the one topic that neither presidential candidate will discuss as it is the hottest and deadliest issue sure to cause political suicide. The laws are there to curb the problem, but those in power and the dogooders are ignoring them at the cost of national sovereignty and deaths of all ages.

    But look at all that lousy finger pointing at the end of the story. It's pretty pathetic. No politician/lawmaker wants to take any responsibility, though they are the only ones who can make laws with teeth in them (legislators) and make sure they're enforced (executive branch, i.e., Gov. Ritter).

    Obviously, the local leaders of the DOJ-FBI, U S Attorney, U S Marshal and DHS must start having coffee with Whitman and Oates. Once a month sounds just about right, until the foreign national assault wanes.

    Each and every human being that carries a gun and wears a badge has no business whining about a fellow officer who happens to wear a different uniform. Each of these cops swore an oath in the shadow of the U S flag. Many brains working the same perp has a magical outcome.

    Until these clowns climb down from their perch and WORK TOGETHER, this Hernandez garbage will repeat over and over again. It is a bad habit to rely upon the DOJ NCIC computer system to replace personal friendships.

    With hard work, the wonderful rank-and-file cops in Denver and Aurora can and will befriend the local -DRO and -ICE agents - and form fast friendships - exchanging PERSONAL cel-phone numbers. However, this will NEVER happen until Ritter, Hickenlooper, Whitman, Tauer and Oates are replaced. These bone-heads will never bend.

There is no state or municipal charge for Illegal Immigration, so holding a mayor or even a governor responsible won't work..trust me, I think Ritter is a PUNK with his "outraged" comment. Friel (through APD) and other departments HAVE sat down with ICE. Most ICE agents are decent, but it's the higher ups that can't or won't do their jobs. A dozen illegal aliens in a van on I-70, stopped by APD...ICE refuses to come get them. Chief Oates begs the ICE Office..they still refuse, the van HAS to be released with only a ticket to the driver for the initial traffic infraction. Let's hold the right people responsible,,the FEDS!!!! If they can't or won't do the job, have a number of local officers from each agency sworn in as federal agents so they can do the job. You think cops want these criminals on the streets? Their families and their lives are endangered by these same illegals, but they have to follow the laws regarding illegal aliens, and those laws are federal.

    Many of these charges are out of Denver. Some were felonies. Even if arrested in a small town, all FELONIES (such as Criminal Impersonation) must be processed in County Court, which on several occasions, was the City and County of Denver.

    This guy apparently entered the US from Guatamela when he was six or seven years old. So he basically speaks and acts like a long term US resident. When Peter Boyles interviewed some ex-ICE agents, they said due to limited resources they tend to check the less-adapted candidates first and put a guy like this lower priority. Sorry, but even though we have respect for the police, they are part of the system and are limited. the best response is to understand it and work to improve the system. It's not about blame so much as how we can advance. Aurora has many inner city problems that a suburban community doesn't understand. It's perceived that it can't happen here.

    The Aurora police are human beings. they make good decisions and sometimes not. But it's the Aurora government to stand up to what happened, not Denver. And it is disgusting that Republicans blame Democrats in Denver for things that go wrong in Aurora.

    My ex, who was from UK and wanted very much to be an American, and who obeyed every law impeccably ( the guy wouldn't even risk a parking ticket) and who was and is well thought of by everyone who knows him, got arrested and deported by ICE because he called and told them he moved but didnt put it in writing, plus he was a little late getting in for his fingerprints - we were breaking up and he was a little distracted because he was a little depressed over the break up. He had most of the process of becoming a citizen completed. ICE actually Stormed the home of one of my friends where he was living during our breakup - a nice, middle class suburban neighborhood and family - agents were hiding behind trees with guns drawn and swarmed over the backyard and etc - SWAT team style. Because the information they had recieved wasn't in writing. ICE is the damned devil lol

    My suggestion is a good old fashioned western ROUND-UP. A local-state-federal task force should be put together to MAKE A LIST of like individuals who are known illegals with multiple arrests who have not been deported. How many individuals might be on such a list? 100? 500? 2500?
    If half the time and money were spent on this as was spent on the DNC, we could make some real progress.

It generally takes a tragedy like this to finally bring them to justice. Three lives lost, families devastated. And law enforcement had 16 times to get it right....and didn't. Shame on you!

    Facts........ Hickenlooper is the Mayor of Denver, and the list of Democrat Mayors for the sanctuary city runs back several years. Ritter is being criticized because he failed to properly prosecute illegal immigrants, and as Governor, the failure continues. Of all people, even more than Governor Owens, Ritter (as a former DA) should know full well the consequences of not taking proper legal action and enforcement of the laws.

    The government continues to fail us even though the overwhelming majority of Americans want closed borders. And it's both sides that are failing us, but the Democrats do shoulder a higher amount of blame considering illegals are one of their groups they like to protect. Something about not breaking families up....... yet it's what is done when someone gets sent to prison, or even when soldiers are sent out of the country. What's sad is evidence shows too many illegals coming here belong to gangs in Mexico, and instead of it being Mexico's problem, it's now the problem of the United States.

    Wasn't it Teddy Roosevelt that rounded up illegals and put them on a boat headed to the southern end of Mexico to return them to their homeland? Maybe that's a practice that should resume.

Then start charging the owners of the cement yard recently in the news, or the packing houses, construction companies with felonies for each undocumented illegal. Write the law race and nationality neutral, just say illegal immigrates, or undocumented aliens like they did in this small town. I wish I could remember the name, I know it worked though, and the town residents were quite pleased. Your going to have to enact tougher laws as voters like the recent one passed in Denver, just keep it race and nationality neutral. Then government has no choice but to honor the will of the majority. Government right now is paying nothing but lip service; time to force them to act unfortunately with more stricter laws put up by voter initatives. I hate more laws, but what else can the majority do if government ignores the law, or tells police departments to disregard enforcement? Property confiscation makes great money for many small town law enforcement departments as well as the DEA. Use it as a model, then maybe like the small town that had this law, your problem with illegals will move somewhere else. Then people like Hinkenlooper will have to hire American people and start supporting American families.

    Francis Hernandez killed three American Citizens.

    The fact that guy's IDs were not previoulsy checked out make the police and judges liable for letting him go. The fact that the police possibly did not do their jobs by detaining him or reporting him to ICE does make them partially at fault for this tragedy. They are partially responsible for the deaths of three people, if by nothing else, negligence.

    The minute this guy broke the law by being here unlawfully, he made himself a criminal, and gave up his rights as such.

    I count 3 separate arrest dates in Denver. If you notice, the arrest on 4/22/06 was for Fugitive Other Jurisdiction, which was for the Felony offense. In other words, he was a wanted felon. Denver arrested him. Somehow they let him go. Since the felony involved criminal impersonation (giving a false name to police when arrested) it might have been a good idea to check out who he really was.

    Nothing will change. It's easy to sit here and scream about how wrong the system is. It requires work to change it.

    I purpose an overhaul to the "war" on drugs. The war on drugs is like taking Tylenol for chronic migraines. Treating the symptoms without addressing the cause. A large portion of the illegal drug trade is due to illegals to begin with. Yet we are throwing money at the symptoms of our ills by supporting the war on drugs. Legalize the “weaker” drugs, that way half our prisons will be available for real offenders. Take a portion of the money saved and fund real education and rehabilitation programs for habitual drug users. They’re sick and in dire need of real help. This would free-up prisons, funds and personnel.

    Stop treating the symptoms and start trying to cure the problems. The money given to Mexico is an absolute waste, but if fits right in with the grand plan. In order to execute change on this level, we need to flush the toilet that is standard two party politics, from Washington DC to my little town of Elizabeth, CO. Vote in other parties. Take to the streets. Revolt.

    Or we can all sit back and watch as the North American Union forms. At that point, our most precious documents will be nothing more than a “gaddam piece of paper” as already stated by the head politician.

    And this will be a crock of shat! The Department of Homeland Security (ICE is part) is swimming in money. They are wasting billions of dollars doing the wrong things, in the wrong way, in the wrong places.
    But America in general is afraid so there isn't much scrutiny going on.

    Let me ask you. Do the staff at RMN always cut off the prior day's blogging, or is my stuff disappearing for a reason? I'm not familiar with their practices, except that they probably try to censor anything that really reveals the shell-game they're part of.

    This whole thing is part of the NAU agenda, the brainchild of Robert Pastor and his fellow toadies at the Council on Foreign relations who want a borderless, regional government which they control, one that is neither elected or accountable. To make sure that happens, they salt our election process with their candidates who run on "both sides" of the aisle, one in each major camp, each of the two major parties - so that no matter who we vote for, their agenda will always prevail.

    The crime this article addresses is the result of the open borders policy of our current - and ANY future administration - that may come to power so as to ensure the North American Union is achieved, no matter whether there is a so-called "Republican" or supposed "Democrat" in the white house. They've already created the EU, the European Union and are already talking about the TAU, the Trans-Atlantic Union, another major stepping-stone towards world government.

    Another side effect of this is that people will start screaming for MORE police, especially of the federalized "Gestapo" variety, the eventual result of which is a police state, voted in and paid for by the taxpayers. This tactic is known as "pressure from below" to get the people in the middle to cry out for "pressure from above" (i.e. government "help" from the legislature...) to get rid of the problem the elites created in the first place, namely their open-borders "one world" policy. It's an obvious Hegelian "problem, reaction, solution" dialectic they're herding the sheople into. They cause a problem, and the citizens predictably react the way their told, which is to accept the pre-ordained solution the elites have in store, which is to have more government. It is in this way that the citizens incrementally abdicate their sovereign power as citizens - to bigger and "better" government.

    BTW: I'm saving each post now since they seem to be disappearing without so much as a notice that it was removed by staff.

    Enough preaching to the choir. Contact your representatives with a little anger and disinchanment attached. To be silent is to be accepting.

After all, they need all the illegals they can get to build all of Aurora's big mega subdivisions. Council's under pressure to keep a hands off policy toward illegals especially when it comes to driving to work. Just like the crack down on drugs in the 70's, a crack down on illegal drivers will take a toll on crime. Criminals don't ride the bus. The reality is that both will implement the same sovereignty-destroying internationalist, corporatist policies that will effectively repeal our Declaration of Independence and Constitution via Robert Pastor's (CFR) plan to build a North American Union, a regional government like that of the EU.     Since the paid mercs in law enforcement will not do their jobs because their paychecks are dependent on doing what the elites order them to do, is there a remedy to this whole situation? The answer is "Yes." When our institutions are clearly compromised by foreign/internationalist influences by traitors in high places, the job then falls to the citizen, who must not resort to vigilantism or the taking of the law into one's own hands. Instead, it must be done under law. Is there such a legal mechanism that allows for direct citizen involvement when our insitution fail? Again, the answer is "Yes." The Supreme Law of the Land, the United States Constitution calls for a citizen force to "execute the Laws of the Union, suppress Insurrections and repel Invasions" when our other institutions fail and fail they have, thanks to the CFR, the TC and all the membership who continuously violate the Logan Act and also commit treason on a daily basis.

    I say it's long overdue for us to fix this problem ourselves and we can do it lawfully, without falling into vigilantism. Although it is the governor's job to revitalize said citizen force by signing it back into law, he will not sign off on a Constitutional citizen-empowering institution whose first job would be to arrest him. So, we must do this ourselves. The Supreme Law of the Land, the United States Constitution (which the CFR is trying to repeal) allows for such to happen in times like these.
