Hit-run suspect likely not a citizen, immigration officials say

A man accused of causing an accident that sent two cars careening into an ice-cream shop, killing a 3-year-old boy and two women, likely is in the country illegally.
Immigration officials have placed a hold on Francis Hernandez, 23, meaning he will be turned over to federal authorities if he is released from jail.
“Although there is conflicting data on his place of birth, it is currently believed that he is a non-U.S. citizen,” Carl Rusnok, spokesman for Immigration and Customs Enforcement, said in an email Sunday.
Hernandez’s arrest record with the Colorado Bureau of Investigation indicates he has listed California, Mexico and Guatemela as places of birth.
Hernandez is accused of driving a Chevrolet Suburban that broadsided a pickup truck Thursday night, sending the truck scraping along the side of a Baskin Robbins at East Mississippi Avenue and South Havana Street.
The pickup truck dragged an electrical box with it and somehow snared Marten Kudlis, 3, as he sat by the window inside the Baskin Robbins. Kudlis was dragged to his death.
Two women in the pickup truck, Patricia Guntharp, 49, of Centennial, and her best friend Debra Serecky, 51, of Aurora, also were killed.
Hernandez ran from the scene but was arrested a couple hours later about five miles away.
He had no driver’s license and no insurance, Aurora police have said. Hernandez has a lengthy rap sheet and may never have had a valid license, police said.
With more than a dozen arrests in the past five years, it’s unclear why Hernandez wasn’t deported.
Colorado passed an “anti-sanctuary” bill in 2006 that requires local law enforcement agencies to report to the U.S. Immigration and Customs Enforcement Agency any illegal immigrants who are arrested or cited for most offenses that are more serious than a traffic citation.
Just this year, Hernandez was arrested by Aurora and Denver police. His last arrest was July 18 in Denver.
Denver police reports do not indicate if Hernandez’ immigration status was checked, and a spokesman said that information couldn’t be tracked down until Monday.
Jail officials, who would have been responsible for notifying immigration officials if police had made a notation, could not be reached for comment.
Colorado’s bill has been criticized as “window dressing” that has not resulted in any extra deportations.
Rusnok said in his email Sunday that there are “many considerations to deportation.”
“However,” he said, “anyone who is illegally present in the U.S. may be identified, located, arrested and utimately deported.”

So many crimes are happening across America, that usually do not warrant any national press report. The question is, has this been going on for decades? That only because we have the Internet, instant communication that everybody knows almost immediately? Or is it because the masses of illegal people entering this nation, without being screened has brought with them a third world mentality? If it wasn't for Independent Journalists like Lou Dobbs of CNN or O'Reilly from FOX, Glenn Beck, as the population of activists Americans would forever remain in the dark. Pro-immigrant zealots don't like it, because the average citizen or legal resident has a say in this explosive issue. Regular citizens have become the first line of defense of corrupt politicians and the special interest lobby, that remain in collusion with far-left (9th district court) judges and extremist groups which border on tyranny.
Those who steal across our perforated fence, includes the criminal element that think they above above US law. Each day citizens are slain on the roads of America, by drunk illegal drivers. This is far from isolated case, because these accident reports are not necessary revealed by the biased press. Pedestrians have become 'road kill' daily, especially when the victims are innocent children. Do not expect to read about this carnage in the New York Times, the Los Angeles Times. You need to dig deeper in rural newspapers or the e-media on the Internet, to find the unsuppressed facts.
Then we have the violent street gangs protected by 'Sanctuary cities' like Los Angeles. The unsuppressed news reports will tell you about the child pedophiles, female assaults, murders, robbers and Social security theft that do not get wide press. Thousands of families are left to pick up the pieces of their shattered lives. The pro-immigrant zealots use the same mantra, that citizens and legal residents commit these crimes also...? But why when we have our own inmate crowding our prisons, should we need to support illegal foreign nationals criminals?
It seems like our 'Rule of Laws' are violated everyday, because the business empire demands cheap labor. Our corrupt politicians play games with American lives because they refuse to enforce immigration laws. All encompassing is the Federal SAVE ACT(H.R.4088) that Speaker Nancy Pelosi is trying to derail along with the original two-tier border fence. We need 'zero tolerance' enforcement, that will give maximum arrest and detainment of predator employers of illegal immigrants.
A new AMNESTY is in the works from Senator Obama, McCain which will flood America with even more of poor, illiterate foreign labor. Continent. NUMBERSUSA. My concern is, if Mr. Hernandez has been arrest by Denver for driving his truck without a license and a number of other charges, how did Mr. Hernandez get his vehicle out of impound two weeks ago, so that he could drive this same truck into this fatal situation? It is difficult to understand that if he has been arrested so many times while driving this truck, why has it not remained in impound rather than to be released to a person who has no insurance, no drivers license and all of his numerous arrest have related around traffic. Did no one understand that when he gets his truck back he drives? Could the vehicle not have been impounded as evidence rather than just a regular impound that could be released back to him. Had it been held in impound, then this incident would never have happened and three people would still be alive. Who should be held accountable for these answers?

For hiring illegal immigrants instead of hiring US citizens and legal residents, which is having a massive negative impact on our economy. Let's demand every employer caught pay the health care, education for illegal alien children, back taxes for state and federal taxes, workers compensation.
A quote from Iowa Gov. Chet Culver. "Some employers improperly hire workers as independent contractors to avoid paying benefits like Medicare, Social Security, insurance and workers' compensation. Employers who contribute to the local economy should not have to compete with those employers, who choose to break the law by knowingly misclassifying their employees, " Parasite employers are stealing jobs from US citizens and legal residents who have a right to work.
We must go after the predatory employers with the federal SAVE ACT (H.R.4088) They must be heavily fined, business assets confiscated and even imprisonment. Chasing illegal aliens around is a waste of time. Any business that has more that (5) five illegal aliens in their employ, should be held accountable with harsh penalties. Don't forget that original stories of this incident included the information omitted here that this man NEVER HAD a driver's license.
Denver just passed a law that vehicles driven by unlicensed drivers must be impounded and sold unless the licensed owner posts a $2500 bond. What happened? Did Mayor Hickey decide to overrule the voters?
Remember this one when you vote this year. They're trying to take away our right to petition items onto the ballot. Politicians say they're only "adjusting" the system by increasing the number of signatures needed to a level and status nearly impossible to meet and keeping such measures out of the constitution. The meaning of that is to keep as many as possible off of the ballot. Those they can't prevent, they want to be able to kill or sneak around.
Don't fall for it. time we passed the same laws as Arizona and Oklahoma. The self deportation from those states is leaving tracks. One illegal is quoted as saying, "Of course I left Oklahoma. There they won't let you work because they are afraid of the new laws. In Texas they let you work."

Look folks get over it; the mayors own employee at his restaurant, a mexican illegal dishwasher murdered a cop, Donny Young; do you think the mayor had the honor to publicly apologize to the rank and file of the Denver police Department? No, he could care less, which is how the rank and file feel about him. Mr. Hinckenloopers name should one be associated with a hedgehoping thief with whom he feels he has a lot in common with. This is a sanctuary city run by a democrat, in a sanctuary state run by another democrat. Democrats love illegals and sanctuary cities so much, they honor them by holding thier convention in a non-union venue, in a sanctuary city. So whats new? Maybe now the city council will see the wisdom of the people who have to pass laws to get thier point across, no more sanctuary city. Now lets pass laws that charge the employers criminally and sieze property from landlords who allow thier property to be used to harbor illegals in violation of the law. City doesn't want to do thier job, it's time for the people to step up and act responsibily by voting in more penalties for those who flaunt the laws of our country, state, and cities. It's simple, we are the people who rule by majority. Just don't single out one type of illegal, do every illegal equal across the board. People get charged with felonies and lose thier property for thier illegal act in violating the law, maybe they'll think twice about breaking the law. Immigration was designed to weed out criminals from other countries, as well as those found to be undesirable. Perhaps if the law would have been told to enforce it properly, this man would not have been here as a criminal with a lenthy record, living in a sanctuary state. We have huge apartment complexes here on South Federal in Denver full of illegals; the city could care less. Now they even protest our country in our very own streets. Intrepid and Scott,
What has people so enraged about this situation is that it's reflective of growing trend that has to be stopped. As a resident of New Mexico, and someone familar with problem of Illegal immigration in this state, I can tell you that approx 40% of the prison population in this state is comprised of non-citizens - the vast majority from Mexico. This is from Data released by the NM Dept. of Corrections.
Another factor enraging so many of us legal residents is that it's the Democrats who ignore this data. They also try to exploit this population for the purposes of gaining political votes. The Democrats actually tried to pass legislation in this state making it ILLEGAL for election officials to ask for official ID when persons try to vote - why, because the illegals will undoubtedly vote for the Dems.
The fact of the matter is that a SIGNIFICANT percentage of this illegal population commits crimes, and this incident is just another example. This trend has to stop and our politicians have to be held accountable
By the way, what moronic judge posted bail at $10,000? The criminal will post his 10% and be in Juarez in 24-48hrs.

Yes, THIS did not happen in Denver. His LAST arrest, was July 18, 2008, WAS in Denver, however. Thanks again Mayor Hick. Hernandez has been arrested 16 times in five years in Colorado. Thanks again, Guv.
According to CBI records, Hernandez has 11 aliases and two listed birth dates, has four listed birth places including Mexico.
The only time I have seen a REPEAT OFFENDER, with a HISTORY of running from the law, failure to appear and warrants for the persons arrest , with another offense pending, AND taken to jail for a NEW offense, and the first bail option being so low, is an illegal alien.
The person who LENT him the vehicle for his last two offenses SHOULD be charged with murder also.

That is because they get free social security money and welfare stamps and medical.
No wonder they want to come here it is like leaving out food for cockroaches.
They come out at night and breed uncontrolled and destroy everything in sight.
Now you get it time to ship the illegals back to Mexico and seal our borders.
No more truckers allowed over the borders only americans can drive trucks in this country.
American jobs for American workers and also lets impound and jail employers who knowing hire these people.
I say if we started putting people in jail for a few years.
Maybe we can stop the flow of illegals robbing us of our future and its resources.

WOW! I just saw the most recent Gallup Poll showing Mc Cain has finally overtaken Obama 48 to 45 point respectfully. That is amazing, it going to be a real fight it looks like. Either way immigration needs to be tightened up, people coming into our country screened for undesirables, the country of origin billed for thier incarceration, and those Americans who choose to break the law held accountable, and new laws passed that force government to end sanctuary, by confiscation of assets used to aid and abet criminal activity, such as houses and apartment buildings that are rented or owned by illegals. Government could clean up and make some much needed revenue off the resale after due process is completed. They want to march we need to use the power of the vote; we'll see which is stonger. We can be just like the country they came from concerning immigration, they don't allow illegal immigration, niether should America. They deport illegal aliens, America should deport illegal aliens. That new law got thier attention, let's enact a few more for the employers to face felonies and landlords face confiscation of property for the property being used to aid and abet illegals in violation of the federal law. We can end much of the problem at the voting booth where politicians truly face the will of the people. If the democrats who claim to be pro-labor support illegal immigration and give sanctuary like Colorado's democrats, vote republican. That voting booth put the bit in the politicians mouth. Now Ritter is putting up 59 on the ballot to end run the TABOR amendment; vote it down if you support TABOR. And when the judge upsurps the will of the people by voiding the the peoples will; vote against thier retention. That ballot box seats the bit in thier mouth, gives the people control over them. When your own mayor's restaurant employs them, and they murder your city's police officers in cold blood and run to Mexico, and the mayor sits there all smug, it's time to vote in some laws that give the people the power to force the issue. This man wouldn't have been able to do this if the law was enforced. From cops to 3 year olds, enough is enough of letting these politicians trample the laws of our nation by randomly selecting which ones they want to enforce. Vote, it's not racist to protect America and Americans from foriegn criminals flooding our nation. So it's getting time, lets start to take action, vote!

anderson,
I still wonder why he got his vehicle back so soon. If it was before the law was approved by Denver voters, it is a textbook example of why that law needs to be obeyed and strongly enforced. It should also be copied by every county in the state, or, to simplify it, passed by the state.
It is not illegal to rent property to illegals. It can be argued that it might be possible to make it illegal. Goal would be to make them not rent or stay.
Best solution would be to follow the logic of the business that employs illegals. They do it for money. Make it too expensive. Make the fines double for each illegal starting at the second one. Fine five thousand for the first add ten thousand for the second, twenty thousand for the third, forty thousand for the fourth and eighty thousand for the fifth. Continue the multiplication across county lines so that a company with six stores or plants hiring illegals will risk not only five thousand dollars for one illegal working at their business but three hundred and ten thousand dollars total. There is no business that will willingly risk such a fine. This also makes it possible to double the fines across the board for a second offense by the same business. Include the loss of a business license for each site for the third incident at that site and no business will take that chance.
A few changes in the independent contractor laws would make it impossible for a construction business to use illegals without responsibility or penalties. The additional fine of double or triple cost for all building permits for that contractor/business for a period of five years would make hiring illegals a death wish for that business.
See anderson, no punishments for illegals, only for employers.
And we should all remember that George Bush was completely behind the amnesty bill. Obama was for it. McCain had his name on it. Our only hope to prevent amnesty is to only vote for those members of Congress who will vote against it!
Get as upset as you like. Americans, a whole lot of them, want an end to illegal immigration. If we don't get it, we will do our best to punish those who dump this country in the trash for their own personal gains.

The caustic rock-throwing in these comments is tearing a great nation apart.
If you are a progressive, what will it take to convince you that illegal immigration is THE biggest and most expensive problem in the USA today ?
With regard to Mr. Hernandez (or whatever his real name is), we must prosecute, convict, and incarcerate him. When his sentence is completed, he must be deported if he is an illegal immigrant.
1. Are you aware that it is unlawful for illegal aliens to come to the USA ?
2. Are you aware that our hospitals, schools, courts, jails and infrastructure are falling apart because the illegal immigrants are here ?
3. Are you aware that people like the three who died in Aurora are needlessly being killed, maimed or injured every day in the USA ?
4. Are you aware that the U S immigration laws have been in effect for a long, long time, for three main reasons;
a. Protect U S jobs for legal U S residents
b. Protect U S legal residents from diseases in third-world nations
c. Protect legal U S residents from felons in third-world nations
Do you agree with these laws ?
5. Are you aware that Denver and Aurora have processes intended to afford sanctuary to illegal immigrants ? Is that appropriate or fair to other criminals, or to YOU and your loved ones ?
6. Are you aware that fully 10% of the more than 40 million fully-employed adult illegal immigrants now in the USA are seasoned felons ? 4 MILION FELONS.
7. Are you aware that Colorado hosts more than 700,000 illegal immigrants, which includes 70,000 felons ?

8. Are you aware that more than one BILLION immigrants want to come to the USA ? Is it discrimination to favor the 40 million already here ?
Would you agree that the three people killed in Aurora a few days ago would be alive today if YOUR three elected folks in the U S Congress had done their job ? Maybe they should vote to put the U S Marines on our southern border to get control of drug trafficking, illegal immigrant flow, and rampant gangster activities ?
The easiest way to prevent future needless deaths is to investigate, prosecute and incarcerate greedy, crooked employers. When we successfully incarcerate 99 of these criminals, the problem will fade away as the employer-peers get legal, the jobs for illegal immigrants dry up in Colorado – and the migrants go ‘back home.’
What will it take to motivate YOU to lead that effort – joining hands with the others who are fed up ? How many more innocent legal U S residents must die needlessly ?
HERE’S THE GOOD NEWS; 62% of the illegal immigrants that come to the USA do NOT want to become U S citizens. All they want to do is earn some money, and return to their ‘home nation’ to make a new start. Do your three elected folks in the U S Congress understand that ?
HERE’S THE BAD NEWS; that means only 38% of the illegal aliens want to become U S citizens, and more than one-fourth of those are seasoned felons. Because the background historical information is so sloppy, we don’t have a good way to sort these folks. The three-ring circus with Mr. Hernandez demonstrates that dilemma. And then there is the dilemma that some 20 million are ahead of them in the legal immigration paperwork line, and the limit is one million per year approved to become citizens.
Let’s work together to solve the illegal immigration problem. While we do that, let's convince the media to report the balanced truth.
