Village at Wolf Creek suit settled

Developers of the Village at Wolf Creek have settled their lawsuit with the ski area’s owners, bringing an end to the last major court case over the controversial resort.
The settlement’s terms are secret, but developer Bob Honts said Tuesday that owners of the ski area and the village “have amicably resolved all their differences in this settlement.”
Honts “absolutely” intends to build the village despite a series of legal defeats this year.
Honts and his business partner, B.J. “Red” McCombs, want to build a resort town for as many as 10,000 people at the bottom of Wolf Creek Ski Area. McCombs and ski area owner Kingsbury Pitcher were once business partners. But Honts and McCombs accused the Pitcher family of reneging on their agreement to extend a road from the ski area’s lower parking lot into the meadow where McCombs wants to build the village.
The Pitcher family sued to get a judge to declare that they had no legal responsibility to help McCombs and Honts build the resort. The developers countersued, claiming fraud and breach of contract on the Pitchers’ part.
Four years and five days after the lawsuit was filed, the two sides agreed to dismiss it.
The ski area’s attorneys at Hogan & Hartson released only a brief statement: “A settlement has been reached between the parties which amicably resolved all issues between them.”
Steve Silvers, a spokesman for the ski area, said he couldn’t answer any additional questions, including whether the Pitchers still oppose Honts’ and McCombs’ plans for the Village at Wolf Creek.
