Immigration agent Cory Voorhis was found not guilty of violating the law by accessing a confidential government database for political purposes — providing information on illegal immigrants used in a campaign attack ad against now-Gov. Bill Ritter.
The federal courtroom was full, with some 50 supporters of Voorhis and members of the public.
The jury apparently rejected the prosecution's argument that they would have to find Voorhis guilty simply if he exceeded his authority in going on the National Crime Information Center computer to obtain information on illegal aliens who won plea bargains while Ritter was district attorney.
Voorhis admitted getting the information and providing it to the Bob Beauprez gubernatorial campaign. But his defense said Voorhis did nothing illegal because he had a good and legal purpose: Forcing change in a bad criminal justice policy.
The U.S. District Court jury took less than three hours to find Voorhis not guilty of the two misdemeanors he was charged with. Voorhis, an accomplished immigration agent, could have faced a possible penalty of one year in prison and a $100,000 fine for each of two counts.
Voorhis told the Beauprez campaign that an accused heroin dealer who pleaded guilty to trespassing on farmland in Denver was the same man later arrested under a different name on a charge of sexual assault on a child in San Francisco.
The sexual assault charge was dropped, but the ad did not say that.
Without the information available through the NCIC database that the two were the same man, the Beauprez campaign had no attack ad, said Assistant U.S. Attorney Greg Phillips in closing arguments Tuesday. The same information was not available through public court records, he said.
"Was the purpose of that ad related to criminal justice?" asked Assistant U.S. Attorney James Anderson. "No, it was one candidate throwing mud at another."
But defense attorney Patrick Ridley insisted that "the reason we are here is the absurdity of the policy" of giving plea bargains to criminal aliens. He also said Voorhis' job description includes investigations that "lead to change in laws," and that justified his actions.

There was an incident in Aspen involving an employee of the police department who checked CCIC files for warrants on his girlfriend. She was wanted. On a Federal warrant charging a credit card fraud in California where the loss was over $250 thousand dollars. They found the printout of his query on the warrant when they arrested her. CBI spokesman Lance Klem, said at the time "It was only a violation of protocol." Klem testified in this case as well. Apparantly telling what an egregious violation it was. But at the time the Aspen incident occured it was no big deal to CBI. But now that it involved a political race, where the light of day was shown on the ex-Denver D.A. looking the other way concerning illegal aliens, The double standard card was played.

The difference between you and i is that I wanted to see the law upheld and that you did not and do not care if he violated the law. You only care that he is on your side. If he had been convicted, you would be on here screaming that is was a witch hunt and that the jury was bought off. For you the ends will always justify the means and if your side "wins" how they get there is irrelevant. That is not a moral position and your personal rants reinforce that.
I continue to have problems with any law enforcement agent that feels he or she is free to use law enforcement data bases for their own purposes, political or personal. The next guy's purposes might not be even this good. Law Enforcement can reach alot of information we might think is private, and if they are free to run around and do what they want with that information, people will get hurt. Voorhies may be not guilty, but his moral standing is hardly pure.

Ellsberg was not a government agent at the time but I am not sure that justifies his actions in violating his top secret clearance. Certainly the illegal actions by the Nixon folks to attack him kind of overshadowed his own moral debates and eventually led to his acquittal. the line between "whistle blower" and political hack is not a bright one. I find it interesting that people that would have hung Ellsberg up will support Voorhis and vice versa.

It is Voorhis and his employer agency causing the problem. Because ICE does not maint ain and keep up with the backlog of illegals now in county jails around the state; does not take them and deport them but allows them to languish in county; it is because Cory is too busy playing politics violating his confidential access to NCIC to do his job of deporting criminal illegals that people like Ritter and other prosecutors are forced to plea bargain just to keep jail populations from overflowing.
If Cory had been doing his job instead of sitting on his butt breaking the law, and started picking up criminals for deportation, maybe I'd feel sorry for him.

ICE deports illegals, not local DAs. Blaming Ritter for having to plea-bargain with illegals is like blaming Mayor Hickenlooper for Iraq.
Ask your local sheriff how much of a problem it is to get ICE to come pick up people marked for deportation, and how hard it is to get reimbursed. ICE is the roadblock here, not the local DAs. And Cory sitting on his butt breaking the law for political purposes when it's his agency that's the plug in the bottleneck.

Clever argument, but I will show where it breaks down:
The charge of Agricultural Trespass was chosen BECAUSE it does not automatically trigger a deportation review. A plea to simple possession of heroin, while still a plea bargain, would be a deportable offense.
Our justice system relies on plea bargains to function. We, the People, rely on out prosecutors to use APPROPRIATE plea bargains.

Anyhoo....I think that dumba$$ should have done time. Certainly as opposed to the two border patrol agents that are STILL behind bars for doing their job concerning yet another ILLEGAL ALIEN DRUG DEALER. Hey, I'm certainly no fan of King George II, that's for sure.
For the record, I'm pro choice AND pro 2nd Amendment. That should demonstrate how unaffiliated I am.
I'd like to point out that I'm NOT AT ALL against immigration. I'm against ILLEGAL immigration. Many, many here fail to make that distinction, and simply call me racist. That's complete BS.
I submit that there's many here who are bigoted against the LEGAL immigrant from the Sudan, or Malaysia, who has done everything according to the book, and it waiting to immigrate to the USA the right way. These people sure seem to heavily favor a particular ethnic group that has the opportunity to sneak over one of our borders. To me, those people are just as racist as anyone.
Interesting how I've been called an ignorant redneck, racist, xenophobe, whoremonger, to name a few, by people who wouldn't know me if I bought them a beer, and who almost certainly wouldn't say it to my face. I stand behind EVERYTHING I say. Thanks.

The ends do not justify the means. If the information had been available through information accessible through means available to the public, there would be no issue.
