Teacher in Brighton sex case jailed for violating probation

The teacher who pleaded guilty to having a sexual relationship with a student at Brighton Collegiate High School is in jail for violating terms of her probation - namely, having unauthorized sex and testing positive for alcohol consumption.

Carrie McCandless began serving a 30- day sentence at the Larimer County Detention Center on Friday after turning herself in to Weld County probation officials.

She did not appear in court to contest the violations, according to officials with the Larimer County District Attorney's Office. McCandless waived the court appearance by signing documents dated March 13.

The sexual encounter was discovered on March 6 when a parole officer arrived at the apartment of a parolee under his supervision and found McCandless in bed. The sexual encounter violated the terms of her probation because it was not reported to or approved by McCandless' treatment team.

The encounter also resulted in a violation of the 8:30 p.m. curfew established as a term of her probation.

The probation violations related to alcohol date back to last year, officials said.

Just a month after being sentenced in June 2007 for unlawful sexual contact with a student and contributing to the delinquency of a minor, McCandless tested positive for alcohol consumption. She also missed two random alcohol tests in February.

McCandless, 32, was chaperoning a group of Brighton Collegiate High School students on a weekend trip to the YMCA of the Rockies in Estes Park in October 2006 when the sexual contact with a student occurred.

She pleaded guilty in April 2007 to two misdemeanors - unlawful sexual contact and contributing to the delinquency of a minor - and to tampering with physical evidence, a felony, and was sentenced to 45 days in jail.

Her attorney, Trent Trani, did not return calls for comment.

    Not sure what the crime is here. Most 17-year boys would be ecstatic about the thought of hooking up with her. Two questions come to mind:

    #1) How many dozens of years would the jail sentence have been if it had been a male teacher going after a 17-year old GIRL?

    #2) How does this square with the fact that DPS hands out condoms to students? The message: "Only have underage sex if it's with someone else who's also underage." Way to encourage more irresponsible behavior, guys.

    I believe, in all seriousness, that if my kid were having a "relationship" with this particular teacher, the trauma would be in me telling him he couldn't have her. He'd hang on to her ankles weeping as she was dragged off to jail. Just my couple cents worth.

    You hit the nail on the head. I have a son and a daughter, and the truth is, they are treated differently, because they ARE different. My boy would be on cloud nine if he had a hottie like this teacher interrested in him, and while I disapprove, I would be hard pressed to explain why he would have to reject her "for his own good", as it were. He'd see through that in a heart beat.
    But my girl child?? Oh, he77 no. I would see her as a vitim of a predator. Girls are different than boys at 17 when it come to how they view power, sex and love. Men in positions of power are different than women too, especially when it comes to kids.
    Justice cannot be met out in an identical way. I for one think it should be related directly to the level of "trauma" inflicted on the "victim".

    If you give your sons as much leeway as stated in 'boys will be boys', what are you going to do when they get arrested for having sex with a girl that is younger than them and they get caught?

Again, men (gay or straight), are different than women in positions of power, especially when it comes to kids. At the age of 17, my son shares the same ammount of cupability for an affair as a daughter would, but he is bigger, stronger, and emotionally equipped differently than she is. In other words, its harder to "victimize" a 17 year old boy, therefore the scrutiny I would place on the adult involved would be different.
    As for the 13 year olds, that's not close to the same thing. 13 is a world away from 18 developmentally. Those are "little girls", and are victims of thier own stupidity as well as victims of all the adults who did not protect them.
    As for the idea that my son might not be able to tell the difference between himself at 17 and a girl at 17 when he is 34--I do hope that any birth defects that may have rendered him that stupid would have been caught before now. I don't think there's much chance of that type of thing happening.
    Comparing boys to girls is much like comparing apples to oranges.

    i went to my 8th grader's math class one day last year to observe..the boys in the class were a little distracted, and the girls were being ignored..grades were dropping and i was the parent in our posse with daytime to spare..holy "expletive here"..the teacher was 2? and made Carrie McCandless look like 3rd hand trailer park trash...she was beyond smokin...the problem was obvious, the boys were all sportin wood and the girls were being ignored as the teacher was busy flirting with the boys....we had her reassigned and everybody's grades went back to norm..imagine what kind of disraction she'd be in a 12th grade class ?.....we need gender specific classes and uniforms for students "and" teachers....jail jumpsuits

When I lived in Massachusetts, there was a case where a young woman and another man held down a woman while her boyfriend raped her. She got probation, the guy who held the other leg got 5 years.

    That is a travesty!! And it illustrates my point that the sentence should fit the crime...Trauma level of the victim is an important factor.
    The young man in this teacher's case was not "raped" or in my opinion "assaulted", or even "sexually abused". Had he been 1 year older, there wouldn't have been a problem. He's more likely now got some emotional abuse issues from having been dragged through all this legal mess.

Now, before you guys go crazy about the fabulous nature of that kind of addiction, you should realize that addiction is "a repeated behavior with known negative consequences." My ex-husband was a sex addict but WEIRDLY enough, didn't like sex. He just liked to jerk off to porn and avoid an intimate relationship. Thoroughly screwed up individual... but it's a REAL disorder and more people than you know have it. A related issue is sexual aversion, which is common with women who have been abused. They "win" their prospective husbands and then won't put out any more. Takes LOTS of counseling and patience. One counselor told me that it might take many years of counseling and that my ex might not ever really change. I bailed after realizing what a psycho-nightmare I had been duped into. whew.

    I had a friend who had the same kind of guy, and thier therapist made a big deal about the whole wacking it to porn thing. Made the guy sound like a total nut job.
    Turned out he just likes porn. Weird, sick man huh. Not that it explains your situation at all, but I feel many "sex addicts" are tagged improperly by shrinks with an agenda.
    See, the deal was, my friend weighed in at about 275, was a total harpie, and felt insecure because her hubby preferred to look at naked porn stars. The shrink took several thousand dollars and many months of thier lives to emasculate a perfectly normal, if lonely, man, and pardoned my friend's food addiction (eating disorder) in the process.
    Is Carrie a sex addict, or a lonely woman with a judgement/libido problem?

Two consenting adults ya know ... and a shot bed :-) The wife and I are headed up to Estes Park later this month to celebrate our 26th anniversary at the same place where we spent our honeymoon. The lodge is already applying multiple preventative coats of ScotchGuard(tm) to EVERYTHING. ;-)

    Yes, it's true that the term sex addict is thrown around a lot. I hadn't heard of it until I got online doing research to figure out why my husband would push me away when I'd initiate sex. Since I had my choice of many men while dating, have a healthy appetite (daily is fine with me) for sex, and have a nice bod and don't nag, I KNEW it wasn't me with the problem. So, again, many people have very distorted views of sex and relationships. My ex saw sex associated with his philandering father, who didn't interact with his mom. So, sex was not included in the marriage...and that's what he sprung on me (or deprived me of, more accurately) after we got married. Back to the subject at hand, this gal obviously has an addiction and there are reasons she's repeating this destructive behavior. I'm quite sure her husband would love for his beautiful wife to be "normal" but there's not a damned thing he can do about it. Shame.

    Maybe she didn't have her daytimer with her to schedule the sexual encounter, so she didn't remember to let her treatment team know about it...
