Feds seek oldest son's medical files

Federal prosecutors want to examine the medical records of former Qwest CEO Joe Nacchio's oldest son, David.

Nacchio's attorneys have agreed to produce the records, but only to U.S. District Judge Edward Nottingham so he can determine whether it's appropriate for the government to have them.

Prosecutors argued in a court filing late Friday that the records are relevant in light of Nacchio's effort to get a shorter sentence because of the health of his son. Prosecutor Kevin Traskos requested a subpoena be issued to Dr. Harvey Hammer, a psychiatrist, to produce the medical file.

David Nacchio attempted suicide while Nacchio was Qwest CEO, according to defense statements at Nacchio's recent criminal trial.

The defense has submitted letters from Hammer describing David Nacchio's condition and the importance of emotional support from his father.
